New York asbestos attorney Joseph W. Belluck says financial restitution is appropriate in cases where environmental crimes endanger public health and require the public to pay for cleaning an illegal asbestos dump site.

In June 2010, a federal judge in New York sentenced Paul Mancuso to six years in prison and fined him $20,000 for multiple violations of asbestos-related environmental laws. That case is United States of America v. Paul Mancuso (Docket No. 5:08-CR-611, U.S. District Court for the Northern District of New York).
Mancuso was previously convicted of similar crimes in federal court in 2003 and in New York state court in 2004. As a result, Mancuso was specifically forbidden from being involved in the asbestos removal industry.
But Mancuso chose to stay in the asbestos removal business by setting up companies in the names of relatives, according to court documents. Mancuso and other family members operated an illegal asbestos removal business, defrauded the government and dumped asbestos on the land of unsuspecting property owners, officials claimed.
After a hearing in December 2010, U.S. District Judge Frederick J. Scullin, Jr., ordered Mancuso to pay $17,900 in restitution to the U.S. Environmental Protection Agency for costs associated with the clean-up of the illegal asbestos dump site in Poland, New York.
The court ordered Mancuso to pay 25 percent of his gross monthly income while he is in custody and $500, or 20 percent of his gross monthly income, after he is released.
“The asbestos left on pipes and on basement floors put innocent homeowners at risk of breathing asbestos fibers and developing mesothelioma, a horrible disease,” says Belluck, who focuses on asbestos mesothelioma claims and asbestos exposure lawsuits.
According to Belluck, the symptoms of mesothelioma can take decades to appear, making it nearly impossible to know the full extent of harm caused by an illegal removal of asbestos.
