New York personal injury attorney Joseph W. Belluck said today that the recent arrest of a Buffalo man on federal charges of illegally storing asbestos shines a light on the health risks posed by the improper handling of the dangerous material.

The Buffalo News reported last week that Sean P. Doctor, a former Buffalo Bills fullback, had been charged with a felony violation of the federal Clean Air Act after federal environmental authorities raided his asbestos removal company’s office April 19 and found a significant amount of asbestos that had not been secured, labeled or disposed of properly.

“Asbestos-removal contractors owe the public a duty to follow state and federal regulations that are aimed at protecting the public from the deadly impact of asbestos exposure, and when they fail to live up to that duty, they must be held fully accountable,” said Belluck, whose New York personal injury law firm, Belluck & Fox LLP, is nationally recognized for its advocacy on behalf of mesothelioma victims.

Because of its flame-resistant qualities, asbestos was widely used in building materials such as insulation through the 1970s. Today, however, the material is in the process of being removed from those older buildings due to its link to serious respiratory diseases, such as mesothelioma, a cancer that affects the lining of the lungs and annually kills an estimated 3,000 U.S. residents.

Due to the highly toxic nature of asbestos, state and federal regulations impose strict requirements on how to safely remove, store and dispose of the material.

“These regulations may be burdensome and difficult for asbestos-removal contractors to follow, but there’s a very important reason why these rules are so strict – asbestos is a serious public health hazard,” Belluck said.

“When those removing asbestos fail to recognize that hazard, or else they act without any regard for it, they need to face the full extent of criminal punishment,” he said. “They also need to make sure that the victims of their carelessness are fairly compensated for their damages.”
