According to the Montreal Gazette, Quebec government officials last week agreed in principle to guarantee a $58 million loan that will be used to expand the Jeffrey Mine – one of the largest open pit mines in North America – into underground operations.
The expansion would allow the mine to annually produce up to 180,000 tons of chrysotile asbestos by 2012 and eventually as much as 225,000 tons per year, with most of the exports going to India, the newspaper said.
Asbestos was once widely used in a variety of products in the U.S., Canada and elsewhere, including in insulation, automotive brakes, fireproofing, pipe covering, cement mixtures, joint compounds and floor tiles. Construction and industrial workers have been especially exposed to the mineral.
Today, asbestos use is limited in the United States but it is still not banned. It is also used around the world in developing countries.
The mineral has been linked to lung cancer and mesothelioma, an aggressive and deadly form of cancer which results from breathing in asbestos fibers that become lodged in the thin membrane that lines and encases the lungs. Each year, more than 90,000 people die from asbestos exposure.
The New York Times recently reported that Philip Landrigan, Dean of Global Health at the Mount Sinai School of Medicine in New York, stated in a letter to Quebec Premier Jean Charest that “there is no safe exposure level. It goes on killing for generations.”
“As an attorney who has seen up close the impact of asbestos exposure on the lives of mesothelioma victims and their families, I can’t imagine how anyone would support expanding this operation,” Belluck said. “It’s time to put an end to asbestos production – period – and put public safety first.”

Belluck said this week that city education officials need to adopt a cautious and careful approach to removing asbestos that was recently found in school lighting fixtures.According to reports by the New York Daily News and public radio station WNYC, the city’s Department of Education announced last week that its plan to replace lights containing cancer-causing PCBs in nearly 800 schools had become complicated by the discovery that the fixtures are insulated by equally problematic asbestos materials.
PCBs have been linked to cancer and other health problems, while asbestos has been linked to lung cancer and mesothelioma, a particularly aggressive and deadly form of cancer that affects the thin membrane lining and encasing the lungs.
“Old schools and factories are often filled with asbestos-containing materials, and if the asbestos is not properly handled and disposed of, the workers removing the asbestos and those who occupy those buildings could be at risk of inhaling asbestos,” Belluck said. “Even though it’s important to remove these contaminated lights as quickly as possible, it’s more important to conduct the removal in a safe fashion.”

This past month, the U.S. Environmental Protection Agency (EPA) added the North Ridge Estates site near Klamath Falls in Oregon to the New Proposed National Asbestos Priorities List. Clapper, Patti, Scweizer & Mason strongly urge the public and asbestos advocacy groups to offer comments in the next thirty days, hopefully influencing the final decision so that the site becomes included on the NPL and qualifies for government clean up funds.According to the EPA, Oregon governor Ted Kulongoski first requested that the North Ridge Estates site be added to the NPL in 2010 due to substantial asbestos contamination in the surface and sub-surface soils. Asbestos, a naturally occurring, fibrous silicate mineral is considered a risk to public health as exposure to the carcinogen causes serious illnesses, such as mesothelioma, asbestosis and lung cancer.
Despite efforts to clean up the site since 2003, including relocating nearby residents for a period of time, the area still remains a high risk to the public. If accepted to the NPL, then the site will be able to be cleaned up under the EPA's Superfund program and redevelopment of the property can proceed.
Until the early 1980's, asbestos was mined and then processed for its properties, which include thermal stability and tensile strength. Thousands of asbestos-containing materials were then made and used in almost all building construction prior to the implementation of environmental regulations in the mid-1980's.
The North Ridge Estate site is now heavily contaminated with these asbestos containing products since many were used back in the early 1940's during construction of a military facility that was originally used to treat Marines during WWII. The materials used to build the military barracks, such as roofing, floor and ceiling tiles, siding and steam pipe insulation, all contained asbestos.
When these buildings were demolished, much of the contaminated debris was disposed of throughout the site- some consolidated into waste piles or buried and some merely scattered on the surface or just below the surface of the soil. This improper demolition and disposal has left North Ridge Estates with unacceptably high levels of contamination.
Despite this contamination, MBK Partnership bought the property in 1977, began construction of homes in 1993, and sold estates up until 2002. In 2003, the EPA began testing the site for asbestos, found unacceptable levels, and began evaluating possible clean up plans. The levels of asbestos contamination were high enough in some areas that people were permanently relocated from their homes in 2006. Clean up efforts have been ongoing, yet there is still much to be done before the area can be deemed safe.
If the site is accepted onto the NPL list, then government funds can be used to complete the clean up under the Superfund Program, which was established in 1980 to address abandoned hazardous waste sites.
If you are a citizen concerned about the ongoing risk of exposure to asbestos from this site, you have 60 days from March 10 to submit your comment for consideration. To submit your comments, use identification docket number EPA-HQ-SFUND-2011-0076 and follow online instructions. After the sixty days, the EPA will publish their final decision on the Federal Register Notice shortly after consideration of all relevant comments.

Due to the highly toxic nature of asbestos, state and federal regulations impose strict requirements on how to safely remove, store and dispose of the material.
“These regulations may be burdensome and difficult for asbestos-removal contractors to follow, but there’s a very important reason why these rules are so strict – asbestos is a serious public health hazard,” Belluck said.
“When those removing asbestos fail to recognize that hazard, or else they act without any regard for it, they need to face the full extent of criminal punishment,” he said. “They also need to make sure that the victims of their carelessness are fairly compensated for their damages.”

On Wednesday, May 11, 2011, after a three-week trial and a half day of deliberations, a unanimous San Francisco jury found Kaiser Gypsum Company, Inc., a manufacturer of joint compounds and wallboard materials, guilty of acting with oppression or malice by clear and convincing evidence. The jury levied a $20,000,000 punitive damages verdict against defendant Kaiser Gypsum Company, Inc. This followed a previous verdict on Thursday, March 17, 2011, after a fourteen-week trial and 2 and a half weeks of deliberations, when a San Francisco jury ruled against defendant Kaiser Gypsum Company, Inc. and defendant FDCC California, Inc. (formerly known as Dinwiddie Construction Company), a general contractor, in a negligence and products liability trial. The jury found that both FDCC California, Inc. and Kaiser Gypsum Company, Inc. were negligent, in addition to determining that Kaiser Gypsum Company, Inc.’s asbestos-containing joint compounds and wallboards were defectively designed and contained a failure to warn product defect. The jury assessed $1,273,421 in economic damages, $15,000,000 in non-economic damages, and $5,000,000 in loss of consortium damages. The jury assigned 7 percent of the liability to defendant FDCC California, Inc. and 3.5 percent of the liability to defendant Kaiser Gypsum Company, Inc.
Mr. John Casey has been courageously battling mesothelioma, an invariably fatal cancer of the lining of the lungs caused exclusively by asbestos exposure, since his diagnosis on January 24, 2010.
Mr. Casey worked as a plumber at numerous high-rise commercial buildings throughout San Francisco between 1961 and 2001 when he retired from working at the University of California San Francisco. Mr. Casey worked directly with asbestos-containing products and near other workers who used and disturbed asbestos-containing products. (John Casey, et al. v. Kaiser Gypsum Company, Inc., et al., San Francisco Superior Court No. CGC-10-275517)
At trial, plaintiffs presented evidence showing that the knowledge of hazards of exposure to asbestos dates prior to the 1920s. Indeed, knowledge of its dangers had progressed to the point of knowing it caused cancer by at least as early as the 1950s.
“We are very gratified with both jury decisions and thankful for their efforts, " said Gilbert Purcell, counsel for Mr. Casey. "Mr. Casey is a wonderful, deserving man and the jury process didn't let him down. We thank the jury for speaking in a loud, clear voice with their message that product manufacturers cannot place profits over consumer safety." The trial, which began in December, was presided over by the Honorable Donald Sullivan who sits in Department 318 of the San Francisco Superior Court.
