Utility Workers at Risk of Asbestos Exposure, New York Mesothelioma Attorney Warns

Workers diagnosed with mesothelioma may be entitled to file asbestos exposure claims and lawsuits, says New York lawyer Joseph W. Belluck.

New York, NY (Vocus/PRWEB) March 18, 2011
New York attorney Joseph W. Belluck said a recent workplace safety study highlights the continuing health risk that utility workers everywhere -- including New York -- face from exposure to asbestos.
Breathing asbestos fibers is linked to mesothelioma, an incurable cancer of the lining of the lung or abdomen that strikes 2,500 to 3,000 Americans each year.
“During the era when many power plants were built, asbestos was widely used as a building material,” said Belluck, a partner in Belluck & Fox, a New York law firm that represents mesothelioma victims in asbestos exposure lawsuits. “Utility workers are among the occupations at highest risk of workplace asbestos exposure and developing mesothelioma. Our law firm fights for New York workers and their families by pursuing asbestos exposure litigation and mesothelioma claims.”
The recent study by scientists in Germany, published in the Journal of Occupational Medicine and Toxicology, surveyed more than 8,600 former and active employees at coal burning and nuclear power plants in Germany to identify occupations at highest risk of workplace asbestos exposure. Power plants produce high temperatures in the generation of electricity, and asbestos was widely used as a heat-resistant insulation in turbines and other areas of plants.
For most workplaces where high temperatures or the need for heat protection demanded the use of insulation, a significant workplace asbestos exposure risk is assumed, the study said. While the study focused on German workers, U.S. utility workers likely faced the same working conditions and dangers from asbestos, Belluck said.
The researchers suggest that workers at power generation plants, including plant operators, metal workers and utility employees, were exposed to asbestos dust. Exposure to asbestos is associated with serious respiratory diseases, including lung cancer and mesothelioma, a cancer of the lining of the lung.
“Asbestos is a toxic material, and for decades asbestos manufacturers profited at the expense of many workers’ health,” said Belluck. “In New York, our laws allow mesothelioma victims and their families to bring asbestos litigation and mesothelioma lawsuits to seek compensation from asbestos manufacturers and employers who exposed workers to asbestos.”
About Belluck & Fox, LLP
Belluck & Fox, LLP, is a nationally recognized law firm that represents individuals with asbestos and mesothelioma claims, as well as victims of crime, medical malpractice, motorcycle crashes, exposure to lead paint and other serious injuries. Partner Joseph W. Belluck is AV-rated by Martindale-Hubbell and is listed in New York Magazine’s “Best Lawyers in the New York Area” and in Super Lawyers. Mr. Belluck has won numerous cases involving injuries from asbestos, defective medical products, tobacco and lead paint, including a recent asbestos case that settled for more than $12 million.
Partner Jordan Fox is a well-known asbestos and mesothelioma attorney who has been named to the Best Lawyers in America, New York Magazine’s “Best Lawyers in the New York Area” and to Super Lawyers. Polaris Enrolls First Patient in Phase 2 Clinical Trial of ADI-PEG 20 for the Treatment of Malignant Mesothelioma

Enzyme-Based Cancer Therapy Now Being Evaluated in Multiple Cancers
SAN DIEGO, March 18, 2011 /PRNewswire/ -- Polaris Group announced today the enrollment of the first patient in a Phase 2 clinical trial of ADI-PEG 20 (pegylated arginine deiminase), the company's novel enzyme-based treatment for malignant mesothelioma. This randomized trial, called "ADAM" (Arginine Deiminase And Mesothelioma), will evaluate the treatment efficacy of ADI-PEG 20 as a single agent compared to the best supportive care. The primary endpoint of the study is progression free survival.
Peter Szlosarek, M.D., Ph.D., of the Centre for Experimental Cancer Medicine, Barts Cancer Institute, Queen Mary University of London, is the lead investigator of the study. "It is with great anticipation that the ADAM trial has opened at Barts and other cancer centers in the U.K., including hospitals in Belfast, Cambridge, Hull, Manchester and Southampton," said Dr. Szlosarek. "We are pleased to be joining Polaris Group in exploring the potential benefits of ADI-PEG 20 in treatment of different cancers."
Malignant mesothelioma is a cancer of the lungs that frequently occurs in people who have been exposed to asbestos. The disease is usually diagnosed two to three decades after prolonged exposure and when it has generally spread beyond the stage for successful surgical treatment.  The prognosis for patients with late stage malignant mesothelioma is poor with a median survival of less than one year.
Polaris Group scientists and colleagues have been investigating the metabolic enzyme argininosuccinate synthetase (ASS) and its presence or absence in relationship to growth of normal cells and tumor cells.  ASS is required for the production of arginine, an amino acid needed for growth and replication of cells. Normal cells have normal levels of ASS and can produce sufficient arginine for their own growth and survival. However, many types of tumor cells cannot make their own arginine due to a deficiency in ASS and, therefore, must obtain it from external sources. ADI-PEG 20 depletes the external supply of arginine, causing these tumor cells to die.
The sensitivity of several ASS-deficient tumor cell lines to ADI-PEG 20 has been recently reported at the 2010 Annual Meeting of the American Association for Cancer Research. Previous studies supported by Cancer Research UK (CR-UK) and conducted by Dr. Szlosarek demonstrated that 63 percent of patients with malignant mesothelioma had low levels or no ASS in their tumor tissues.  The study also demonstrated that viability of mesothelioma cell lines from these patients declined markedly when deprived of arginine if they were ASS-negative.
Robert Jackson, Ph.D., chairman of the CR-UK Discovery Committee, and a member of the Polaris Scientific Advisory Board, commented: "We are very excited to have started the study with ADI-PEG 20 in malignant mesothelioma. Dr. Szlosarek has been one of the leaders in researching and targeting ASS-deficient tumors with ADI-PEG 20. The initiation of this mesothelioma trial with ADI-PEG 20 is a good example of a CR-UK funded laboratory study forming the basis of a new experimental treatment. CR-UK is committed to such important translational research initiatives in cancer."
John Bomalaski, M.D., executive vice president, medical affairs, of Polaris Group, added, "We are very excited about the potential of using ADI-PEG 20 to treat multiple forms of cancer. We are already evaluating ADI-PEG 20 in a Phase 2 trial in small cell lung cancer, and we look forward to initiating additional trials in tumors with a high degree of ASS deficiency. Our belief is that ADI-PEG 20 will play a key role in the future as single agent therapy or in combination chemotherapy for several cancers that continue to evade effective treatment."
About Polaris Group
Polaris Group is a privately held multinational biopharmaceutical company that specializes in the research and development of protein drugs to treat cancer and other debilitating diseases. The company's lead therapeutic, ADI-PEG 20, is advancing into a pivotal Phase 3 trial for hepatocellular carcinoma. Polaris is also investigating ADI-PEG 20 as a treatment for other arginine-dependent cancers, such as prostate cancer, leukemia, lymphoma, sarcoma and pancreatic cancer. In addition to the ADI-PEG 20 project, Polaris is researching and developing other biotherapeutic agents and has a small molecule drug program that utilizes rational structure-based approach to design novel compounds that inhibit the biological function of cancer-related protein targets.

PERRYSBURG, Ohio, March 14, 2011 /PRNewswire/ -- Owens-Illinois, Inc., (NYSE: OI) today issued the following statement concerning the verdict handed down late Friday afternoon by a McLean County, Illinois, jury against four defendants, including Owens-Illinois, in a case alleging asbestos-related injuries. Of the total $90 million awarded by the jury against the four defendants, a combined $9.6 million in compensatory damages were assessed against all defendants, and $40 million in punitive damages were assessed against Owens-Illinois.

"Owens-Illinois is disappointed in the jury's verdict. The plaintiff never worked for Owens-Illinois or in an Owens-Illinois facility, nor did he allege exposure to asbestos-containing materials made or sold by the company. His alleged exposures did not occur until 1972, which was 14 years after Owens-Illinois last made or sold thermal insulation products containing asbestos. The plaintiff claimed, however, that Owens-Illinois participated in a conspiracy with other companies to conceal or misrepresent information about the health risks associated with asbestos exposure.
Owens-Illinois did not conspire with anyone concerning asbestos health hazards, continues to deny these conspiracy claims, and will challenge this verdict, if necessary, in the Illinois Appellate Courts. The company has successfully defended its position in similar cases and is confident of a successful outcome in this matter as well. Owens-Illinois does not anticipate any changes to its 2011 financial outlook as a result of this case."

The Mesothelioma Victims Center says, "Most US citizens have heard about mesothelioma, but they really do not know what it is. Of the 3000 mesothelioma diagnosed individuals in the United States, one third are US Navy Veterans." The group says, "Unlike other forms of cancer, mesothelioma may take thirty, forty, or even fifty years to develop. Your typical just diagnosed individual dealing with a mesothelioma is in their late 60's, or early 70's. The horrible thing about mesothelioma is it typically shows up out of the blue-no warning-no warning signs. Frequently mesothelioma is misdiagnosed as pneumonia. New York Mesothelioma Lawyer Warns Homeowners To Avoid Asbestos Exposure When Renovating Older Houses

New York Mesothelioma Lawyer Warns Homeowners To Avoid Asbestos Exposure When Renovating Older Houses

New York mesothelioma lawyer, NY asbestos attorney, New York personal injury law firm, asbestos-related lung disease, renovation exposure, toxic materials
New York mesothelioma lawyer Joseph W. Belluck
Quote startFor decades, the housing and building products industries ignored the harm that can be caused by asbestos, so asbestos fibers may be in millions of homes across the U.S. and Canada.Quote end
New York, NY (Vocus/PRWEB) March 12, 2011
Although it makes economic and environmental sense to renovate your home to make it more energy efficient, homeowners need to ensure that they are not exposing themselves and contractors to dangerous asbestos in the process, New York personal injury attorney Joseph W. Belluck said today.
Citing a recently issued report by the Canadian Environmental Law Association (CELA), Belluck said that older homes, in particular, may contain asbestos which can release toxic fibers when disturbed.
Asbestos fibers can become lodged in the lungs and cause mesothelioma, an incurable, highly aggressive form of cancer that claims the lives of 2,500 to 3,000 Americans every year.
“For decades, the housing and building products industries ignored the harm that can be caused by asbestos, so asbestos fibers may be in millions of homes across the U.S. and Canada,” said Belluck, a partner in Belluck & Fox LLP, a New York law firm that represents mesothelioma victims.
“As this report suggests, we need to educate homeowners and contractors who are doing these renovations so that they aren’t unknowingly exposed to this highly toxic material.”
According to the CELA report, there are several ways a person can become exposed to asbestos when renovating a home, including:
  •     Disturbing loose-fill insulation and ripping away hot water tank insulation;
  •     Removing roof shingles or siding;
  •     Sanding or scraping asbestos floor or ceiling tiles;
  •     Sanding plaster or coatings, such as roofing compounds, sealants, paint, putty caulking and drywall products that contain asbestos.

Belluck said the risk of asbestos exposure is particularly high in homes that were built prior to the 1980s. Since that time, the use of asbestos has been reduced although not outright banned in the U.S.
“If there is asbestos in the home, it should not be handled by a general contractor or homeowner working on a do-it-yourself project,” Belluck said. “This is something that must be handled and disposed of by a highly trained, certified asbestos contractor.”
Belluck said it is important for people to contact a New York mesothelioma lawyer if they believe that they or a family member has been diagnosed with mesothelioma.
Compensation is often available to victims of mesothelioma who file claims, he said, and there are various legal options to help mesothelioma sufferers pay for their medical bills and treatments.

The Mesothelioma Victims Center is the premier US advocate for an individual diagnosed with mesothelioma, or family members dealing with a mesothelioma diagnosis. The group offers unparalleled free help, support, and advice, or an individual, or a family dealing with this rare form of cancer. The group says, "Mesothelioma has struck our families twice, in one instance involving a veteran of the US Navy, so we understand the what do we do next dilemma faced by most individuals, or family members, dealing with a mesothelioma diagnosis, and in response we have built a very robust free service that is unparalleled in the US." They say, "The worst thing about a mesothelioma diagnosis is it typically comes out of the blue. In many cases the mesothelioma victim had his, or her asbestos exposure thirty, forty, or even fifty years ago, and then in their late 60's, 70's, or even 80's they get this diagnosis. Our service is free, and it is designed to be without equal, when it comes to every need a individual, or family might have with respect to mesothelioma." http://MesotheliomaVictimsCenter.Com
Mesothelioma is a rare form of cancer, that is a result of exposure to asbestos. Tragically, one third of all US mesothelioma victims served in the US Navy. Other high risk groups for mesothelioma include individuals who worked in mines, oil refineries, shipyards, power plants, or as carpenters, plumbers, boiler room technicians construction demolition, auto brake repair professionals, HVAC technicians, city, or county municipal water department workers. http://MesotheliomaVictimsCenter.Com
Many mesothelioma victims may be eligible for significant compensation. Typically mesothelioma lawsuits are tailor suited for the specific victim. In reality, there are but a handful of U.S. mesothelioma lawyers, or attorneys that are the most successful with these types of lawsuits. The Mesothelioma Victims Center will give a mesothelioma cancer victim or their family the names of the most successful mesothelioma law firms in the nation. No other mesothelioma group in the United States will do this. In addition, they will assist the mesothelioma victim with Social Security or VA disability benefits, and they will tailor suit a specific report, that details health treatment options in the specific area, of the mesothelioma victim. A diagnosed victim of mesothelioma, or their family can call the Mesothelioma Victims Center anytime at 866-714-6466, or they can contact the group via their web site at http://MesotheliomaVictimsCenter.Com

Washington, DC (Vocus/PRWEB) March 07, 2011
The Mesothelioma Applied Research Foundation (Meso Foundation) announced today the recipients of its annual awards which will be presented on June 24, 2011 during the International Symposium on Malignant Mesothelioma in Washington, DC.
Every year, the Pioneer, Hope Builder and Volunteer of the Year Awards honor individuals who, through their efforts, advance Meso Foundation’s mission to eradicate the suffering caused by mesothelioma through science, advocacy, support, and awareness-building.
This year’s Pioneer Award recipient is Dr. Raffit Hassan, Senior Investigator and Chief of the Solid Tumor Immunotherapy Section in the Laboratory of Molecular Biology at the National Cancer Institute (NCI) and former Chair of the Meso Foundation’s Science Advisory Board. Dr. Hassan is receiving this award for his exceptional work on targeting mesothelin, a protein highly expressed in mesothelioma, for the treatment of patients with mesothelioma. Dr. Hassan’s research, which had begun in the laboratory while he was a fellow at the NCI, has now developed into two successful clinical trials with a third one about to open, providing mesothelioma patients with the potential of much-needed new treatment options. The Meso Foundation also wishes to thank Dr. Hassan for the remarkable leadership in his role as Chair of the Meso Foundation’s Science Advisory Board. Dr. Hassan, whose term ended in December of 2010, has been instrumental in ensuring a rigorous peer review process to facilitate the funding of the most promising mesothelioma research.
Every year, the Volunteer of the Year Award honors an individual who has devotedly volunteered their talent, time, and resources and who, through active community participation, fundraising, awareness-building and advocacy, has advanced the mission of the Meso Foundation. Larry Davis, a dedicated Meso Foundation volunteer and mesothelioma patient, is the recipient of the 2011 Volunteer of the Year. Mr. Davis, an avid runner, whose passion and determination have been an inspiration for many, has made it his mission to find effective treatments and to cure mesothelioma. In his home state of Florida, he is known for organizing a sanctioned 8K race benefiting the Meso Foundation and its mesothelioma grant research program and raising much-needed awareness of this disease. Politicians, journalists, business people, doctors, and anyone else in the position to be helpful in the fight against mesothelioma has likely received an email or phone call from Mr. Davis with a request for help. Through his outreach, Mr. Davis has secured national media coverage of the Meso Foundation and its mission, and has promoted the critical need for research.
Linda Reinstein, co-founder of the Asbestos Disease Awareness Organization (ADAO) is this year’s recipient of the Bruce Vento Hope Builder Award, named after former Congressman Bruce Vento, who lost his battle with mesothelioma in 2000. Ms. Reinstein, who in 2006 lost her husband Alan to mesothelioma, has been at the forefront of national and international advocacy efforts to ban asbestos, the substance known to cause mesothelioma and other asbestos-related diseases, which has not yet been banned in the United States. The Mesothelioma Applied Research Foundation recognizes that increased awareness of asbestos and ultimately a ban, play an important role in the fight to eradicate mesothelioma. Specifically, a ban on asbestos paired with Meso Foundation’s independent peer review research program, which is aimed at improving medical treatments and developing a cure, are essential elements in ending suffering caused by this insidious disease.
Mesothelioma is a malignant tumor of the lining of the lung, abdomen, or heart known to be caused by exposure to asbestos. Medical experts consider it one of the most aggressive and deadly of all cancers. Approximately 3,000 Americans are diagnosed with mesothelioma every year.
ABOUT THE MESOTHELIOMA APPLIED RESEARCH FOUNDATION
The Meso Foundation is the leading organization dedicated to funding peer-reviewed mesothelioma research, providing patient support services and education, and advocating for increased federal funding for research. Mesothelioma funding, per death, has historically been extremely low, and even as recently as 2007, the NCI reported that mesothelioma receives as little as 9 times less funding than other cancers. The Meso Foundation was founded in 2000 to address this imbalance and since then has funded over $7.1 million in peer-reviewed mesothelioma research.

The Foundation hosts an annual conference, the International Symposium on Malignant Mesothelioma, which unites doctors, researchers, patients and families, legal advocates, union representatives, and other affected and concerned individuals, to share information and advance mesothelioma research. The 2011 Symposium will take place June 23-25 in Washington, DC. For more information, please visit http://www.curemeso.org.
